Ducks Unlimited (DU) sells wetland mitigation credits in several watersheds in New York State through the New York In Lieu Fee Program, which continues to expand. DU is also establishing the Long Island In Lieu Fee (ILF) Program to offset freshwater and tidal wetland impacts.
Additionally, our sister DU Vermont ILF Program also provides wetland credit availability in the NY portion of the Lake Champlain Basin.
By purchasing wetland mitigation credits from the ILF program, permitees transfer their mitigation requirement to DU. By making payment to a DU ILF Program, the permittee transfers responsibility for delivering compensatory mitigation projects to DU. Our ILF projects offer greater ecological benefits that contribute to watershed-level conservation goals. These projects have resulted in the protection of habitats with regional conservation significance for connectivity, flood mitigation, rare species, and waterfowl.

We bring this legacy to the mitigation space to accelerate the pace and scale of conservation, ensuring that wetland and waterfowl habitat quality improves over time while helping Permittees meet regulatory requirements efficiently and effectively.
In New York, including both voluntary and compensatory mitigation efforts, DU has conserved over 59,478 acres through partnerships focused on land protection, restoration, and enhancement of wetlands and waterfowl habitat. DU’s New York ILF Program has protected over 1600 acres of high-quality wetland habitat, restoring hundreds of acres on those tracts. ILF projects underway expand state wildlife management areas including Galen Wildlife Management Area in Clyde, where DU has also grown state land holdings through voluntary efforts.
The ILF programs have also protected 289-acres in Clay/Brewerton where DU has restored 60 acres of wetlands including a range of cover types. DU has restored important wetlands in the Tug Hill and St. Lawrence River regions as well. DU’s Eddy Rd mitigation site was part of a larger 440-acre acquisition that was funded through both compensatory mitigation and voluntary funding. Permitees able to use the ILF program are consistently contributing to larger scale conservation efforts as a result of working with DU.
Several regulatory permitting pathways are able to use the ILF Program including section 404 permits, NEPA no-net loss requirements, environmental damages, and certain state issued permitting mechanisms. The Office of Renewable Energy Siting (ORES) can permit the purchase of ILF credits as offsets for large scale renewable energy projects.
