Mitigation is a requirement of permitted wetland impacts issued under Michigan State law (Part 303, Wetlands Protection) and federal law (Sect. 404 of the Clean Water Act). Michigan operates as a state-assumed 404 state, with the Michigan Department of Environment, Great Lakes (EGLE) running the regulatory permitting program. EGLE prefers utilization of bank credits to permittee responsible mitigation because banks establish new wetlands in advance of losses and consolidate smaller projects into large ecologically significant projects managed by conservation professionals. DU offers both credit and permittee responsible options in the state.
DU has options to contractually reserve credits during permitting phases of projects. Reserving credits ensures credit availability prior to anticipated wetland impacts, resulting in reduced project timelines and price stability.
