DU's wetland mitigation program is designed to utilize DU's wetland conservation experience to generate revenue to support our conservation goals across North America. DU's wetland mitigation program only provides services to developers that have avoided and minimized their impacts to wetlands, and must provide compensatory mitigation for their remaining unavoidable impacts authorized by federal and/or state regulators.
Compensatory mitigation can be provided by three methods:
A mitigation bank is a site, or group of sites, where aquatic habitats (e.g., wetlands, streams, riparian areas) are restored and conserved by an investor for the purpose of providing compensatory mitigation for future authorized impacts. A mitigation bank sells mitigation credits to developers whose obligation to provide compensatory mitigation is then transferred to the mitigation bank sponsor. The operation and use of a mitigation bank is governed by a mitigation banking instrument approved by the regulatory agencies. Ducks Unlimited can reduce risks of failure and maximize returns for investors by applying our vast wetland restoration and management experience. No other organization has a staff of professional engineers and wetland scientists that has the wetland restoration and management experience of DU.
In-Lieu Fee Programs
An in-lieu fee program is operated by a governmental agency or natural resources non-profit, such as DU. Similar to a mitigation bank, an in-lieu fee program sells mitigation credits to developers. However rather than utilizing an investor the fees are used to implement projects. The operation and use of an in-lieu fee program is also governed by an in-lieu fee program instrument approved by the regulatory agencies. By using our conservation planning tools, Ducks Unlimited can implement in-lieu fee mitigation projects within the watershed to maximize benefits for multiple species of fish, wildlife and waterfowl.
The remaining alternative is for the developer to undertake their own restoration project which fulfills their compensatory mitigation requirements. The developer retains full responsibility for the success and long term management of the project. By utilizing DU's wetland conservation experience to plan, design and implement a restoration project developers can minimize their risk of failure and long term obligations.
