Tax Smart Giving

Congress passed the American Taxpayer Relief Act (ATRA) in January 2013. In doing so, they did several good things, such as renewing the IRA Charitable Rollover legislation. However, they also passed legislation that impacted many Americans when it came to their respective income tax brackets. Ducks Unlimited’s Gift and Estate Planning department has representatives who are happy to speak with you or your advisors regarding ways to not only maximize your support of wetlands conservation, but also to help you adjust to the new regulations instituted by the American Taxpayer Relief Act.

The IRA Charitable Rollover is an excellent opportunity for Ducks Unlimited supporters age 70 1/2 or older. This legislation expires at the end of 2013, and with uncertainties in Congress, there is no guarantee we will ever see this again. Many supporters have found this to be a valuable tool to avoid the necessity of claiming a required minimum distribution (RMD) as income, or reducing the amount of future RMDs, which could have serious tax implications. This legislation allows you to transfer up to $100,000 from your Individual Retirement Account (IRA) directly to Ducks Unlimited. Once again, we are happy to speak to you, or your advisors, regarding this opportunity.

Some other potential options to consider are Charitable Trusts or Gift Annuities. Either of these may be funded using appreciated assets, which are subject to a slightly different capital gains tax from years past. The stock market, for instance, has had a very good year and those of you with long-term stocks may have had much greater gains than anticipated. We encourage you to visit with your attorneys or advisors and consider whether or not these types of gifts are in line with the conservation legacy you wish to craft, or if these may benefit you and your family.
